In essence it is designed to limit the information that can be introduced during a case to that which has been disclosed (i.e., discovered). The defendant can ask for all memos a CEO wrote on a certain topic, the prosecution cannot then introduce a memo saying 'x and y have ageed not to act in tandem' if it was not a document disclosed in the discovery package. However, if the prosecution has a video of the defendant with the gun in his hand (as it were) and the defence has not asked for 'all videos of the defendant with the gun in his hand' it can be introduced as evidence. It follows therefore that the defence will ask for a huge amount of documents to see what the prosecution has and the prosecution may well hope that the defence misses some avenue on which they (the defence) may succeed. If a witness destroy documents before or after discovery has been sought and the document subsequently emerges (e.g., emails have a recipient and a sender) then the judge may choose to find the witness in contempt of court and a custodial sentence may follow. Alas, with a tough AFL match-up at hand, McGlynn fit and Ty Vickery likely to spend a bit of time in the ruck I've had to pull the pin on both of them and give them a rest this week. That said, Otten may still be a late in up back. We'll see.
